2006 State and Federal Legislation Update

The 2006 State and Federal legislative session resulted in many new laws affecting OCFS, the local social services districts and the children and families of New York State. Important initiatives were enacted pertaining to child protective services, as well as measures pertaining to foster care and adoption. Technical clean-up legislation was enacted to facilitate the continued implementation of the Permanency Bill enacted in 2005.

PINS Reform Legislation

Part E of Chapter 57 of the Laws of 2005 has enacted new statutory provisions which change the Statewide approach to youth who are at risk of becoming a Person In Need of Supervision (PINS) and their families. The new provisions require diversion services to be provided to all youth at risk of becoming a PINS and their families and discourage the use of detention for PINS youth. The new requirements will keep more youth in their homes and communities by requiring the counties to provide alternatives to detention including respite and crisis intervention services to families.
